Doctor's-Note & Sick-Leave Laws in Delaware

Illustration representing doctor's-note and sick-leave rules in Delaware

Can a Delaware employer require a doctor's note? Generally yes. No federal or Delaware law prohibits it, and Delaware has no general accrued paid-sick-leave mandate, so whether you need a note is set by your employer's policy. Delaware's new paid-leave program covers serious conditions and family care, not routine sick days.

Delaware has no statewide law requiring private employers to provide accrued paid sick leave for routine illness, so short-term sick time is a matter of employer policy. Delaware did launch a state Paid Leave (paid family and medical leave) program under the Healthy Delaware Families Act, with benefits beginning January 2026 — but that covers serious health conditions, family caregiving, and parental leave, not a one-day cold. Employers may ask for a reasonable doctor's note under their own policy.

How sick leave works in Delaware

Delaware does not have a statewide law requiring private employers to provide accrued paid sick leave for routine, short-term illness. Paid time off for a one- or two-day illness is a matter of employer policy or contract.

Delaware did create a state Paid Leave program under the Healthy Delaware Families Act. Payroll contributions began in 2025 and benefit claims opened in January 2026. This program is paid family and medical leave: it provides partial wage replacement for an employee’s own serious health condition, family caregiving, parental leave, and certain military-family needs. It is structurally different from accrued sick days and is not intended for a routine short illness. Employers with 50 or more employees may also be subject to the federal Family and Medical Leave Act (FMLA) for unpaid, job-protected leave.

When a doctor’s note can be required

No Delaware statute covers routine absences like this, so the employer’s own policy sets the terms. What a policy like that usually wants is a note from a licensed physician that states the dates without a diagnosis attached.

None of this is legal advice, just a plain summary. Confirm anything urgent with the state agency or an employment attorney.
